The Claim Arrives After Closing

The loan funded, the borrower moved in, and eighteen months later a demand letter arrives alleging that the rate was misrepresented or that a disclosure never reached the borrower. Mortgage broker errors and omissions claims are documentation claims far more often than credit claims.

Quick answer: mortgage broker E&O covers claims that your origination, brokering, or advisory services caused a borrower, lender, or investor financial loss, plus the cost of defending you. Lenders and investors frequently require proof of it before they will accept your files.

The Claims That Actually Happen

Disclosure failures

A Loan Estimate or Closing Disclosure that was not delivered within the required timing, or a fee that changed without a valid changed circumstance. These are technical claims with real defense costs, and regulators may be involved as well.

Rate lock and deadline failures

A lock expired because a condition was not cleared in time, and the borrower now faces a higher rate. The claimed damages are the payment difference over the life of the loan.

Misrepresentation to borrower or lender

Stated income, occupancy, or asset documentation that does not match what was submitted. Even when the borrower supplied the information, the file needs to show what you verified and what you disclosed.

Failure to place or follow lender guidelines

A loan submitted outside an investor's overlay, then repurchased. The investor's claim can be substantial, and it is not always covered by a borrower-focused policy form.

Third-party vendor failures

An appraiser, title company, or notary error that becomes your claim because you selected the vendor.

What E&O Pays, and What It Does Not

Typically covered: defense costs, settlements and judgments for professional services allegations, regulatory inquiry response in many forms, and claim expenses such as expert review and records production.

Frequently excluded: fraud and intentional misrepresentation, commingling or conversion of funds, fee disputes, employment claims, and in some forms, repurchase or indemnity demands from investors. Read the exclusions before assuming a warehouse lender claim is covered.

Most mortgage E&O is claims-made. The retroactive date determines which prior files are covered, and the reporting requirement means a claim reported after the policy ends is uninsured without tail coverage.

Requirements You Are Already Subject To

California mortgage brokers and lenders operate under licensing and disclosure rules administered by the state, and loan originators are tracked through NMLS. Beyond regulation, your agreements with wholesale lenders and investors almost always include insurance requirements: specific limits, additional insured status, and notice of cancellation. Those contracts, not the state, are usually what forces an E&O purchase.
